Once you have made the decision that your marriage has irretrievably broken down and that there is no hope of a reconciliation, you can commence divorce proceedings by contacting Jemma who is a specialist family law divorce lawyer.
Unless there are special circumstances, the procedure you shall need to follow shall be on the online process via gov.uk.
The Divorce and Dissolution and Separation Act 2020 (DDSA 2020) became legalisation in 2022.
On the 6th April 2022 the Act amended the Matrimonial Causes Act 1973 and the Civil Partnership Act 2004 to make a divorce “no fault”. This therefore results that it is no longer necessary to cast blame against the other party. This shall enable your divorce process to progress with less acrimony and in a much more amicable way, which is of benefit to both parties.
The Petitioner is now known as the Applicant and the other party shall still be known as the Respondent.
The procedure tends to take between six and nine months but may be longer if there are complications.
Each case is different, and Jemma is here to advise and assist you every step of the way so that you have clarity and a full understanding of the process, so that you know what to expect and to be fully appraised of all that you need to do to obtain your Decree Absolute, which effectively replaces your marriage certificate.
